2.1. Consent

By using this Website, you consent to the collection and use of the information as described in this Privacy Policy. If we decide to make changes to this Privacy Policy, we will post the changes on this site so that you will always know what information we at ESS collect, and how we use it.

2.2. Use and purpose of collected personal data
What information do we collect and for what purpose?

2.2.1. IP addresses
We use IP addresses to diagnose problems, to administer our website, and to gather demographic information. When you visit our website, we recognise only your domain name, not your email address. We only see your email address if you give it to us directly by filling out a form or sending us an email.

2.2.2. Cookies
We use cookies to deliver personalised content, to save you having to re-enter your password repeatedly, and to tailor our information offerings to how you and others use the website.

2.2.3. User registration
If you register, we will send you the requested information and/or products as well as other product information, news or promotional material.

2.2.4. Email addresses
If you choose to give us your e-mail address, we will communicate with you via e-mail. We do not share your e-mail address with others outside ESS.
If you no longer wish to receive e-mails from us, you can unsubscribe at any time. Depending on how your e-mail application is set up, information about you may be transmitted automatically. ESS will also treat this data as confidential.

Our site includes forms that you can fill out to request information, products and services.

The data thus transmitted to ESS will exclusively be used by us for this specific process.

Our website may contain links to other third-party websites. ESS is not responsible for the privacy practices or the content of other websites.

2.4. Newsletter
ESS sends out user and seminar newsletters at regular intervals, which you can subscribe to free of charge to stay up to date about current program innovations and changes, events, seminars and ESS’s promotional activities. If you no longer wish to receive emails from ESS, you may

revoke the authorisation you had previously granted at any time. To be removed from the ESS mailing list or ESS web registration database, simply send an email to info@ax3000-group.at.

2.5. The use of Google Analytics 
This website uses features by the web analytics service Google Analytics. The provider is Google Inc. (‘Google’). Google Analytics uses ‘cookies’. The information generated by the cookie about your use of this website (including your IP address) is generally transferred to and stored on a Google server in the USA. Google will use this information to evaluate your use of the website, to compile reports on website activity for the website operator, and to provide other services related to website usage.

Google may also transfer this information to third parties if required by law or if third parties process this data on behalf of Google. Google will not associate your IP address with any other data held by Google.

2.7. Social Bookmarks
Our website contains social bookmarks (such as Facebook and YouTube). ‘Social bookmarks’ are Internet bookmarks with which users of such service can collect links and news items. These are incorporated in our website merely as a link to the respective services. Only after clicking the embedded graphics will you be redirected to the website of the respective service provider, i.e., only then will user information be transmitted to the respective service provider. Information regarding the treatment of your personal data when using those websites with social bookmarks can be found in the respective providers’ privacy policies.

3. DATA PROTECTION – GENERAL

ESS stores personal data in order to fulfil orders and provide further customer service.

3.1. Personal data and processing
For example, name, company name, address, telephone numbers, email addresses, VAT number, company registration number, industry sector, contact persons, for SEPA direct debit mandates:

bank details, correspondence, licence and update information regarding the order, contact origin, Client Info login details. If no purchase agreement is concluded, your data will be used for advertising purposes. You can ask ESS to delete your data at any time.

3.2. Third party data transfer
Data will only be passed on to us if this is necessary for the fulfilment of the contract.

We only pass on your personal data to third parties if:

  • you have given your express consent,
  • the disclosure is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
  • in the event that there is a legal obligation to pass on the information,
  • and this is legally permissible and necessary for fulfilling contracts with you.

3.3. Confidentiality
ESS, its employees and agents undertake to maintain data confidentiality in accordance with section 6 of the Austrian Data Protection Act (DSG) and article 28 (3) of the GDPR as amended. A separate non-disclosure agreement can be requested from ESS.

3.4. Order data processing agreement in accordance with the GDPR
All information on the processing of personal data can be found in the order data processing agreement.

 

4. DATA PROTECTION INFORMATION – MAINTENANCE

4.1. Information about services arising from the maintenance contract
If services arising from a maintenance contract are used, ESS electronically stores data to trace reported questions and problems, error analyses and related support information, etc. (phone calls, tickets).

5. DATA PROTECTION INFORMATION – ORDER DATA PROCESSORS

The following services provided by ESS fall within the scope of the GDPR under the term ‘order data processing’:

5.1. Support services on site at the customer’s premises
This includes training courses for the introduction of the software and other services that are carried out on site at your premises.

5.2 Support via remote maintenance
For ESS to process your inquiry, you grant direct access to your system.

5.3 Support with remote access via software
To process an inquiry, ESS will perform an online session on your workstation. Before the service can be performed and your screen content is transmitted, you must confirm access.

5.4 Error analysis with customer data
If your data are required for error analysis or for the performance of services, you will transmit them to ESS. The data is only stored for the duration of the error analysis and then deleted. We would like to point out that data transmission on the internet (e.g. when communicating by email) may involve gaps in security. Complete protection of data against access by third parties is not possible.

6. DATA PROTECTION INFORMATION – APPLICATIONS

ESS collects and stores your data to process your application.

6.1 Collection and use of applicant data
In the course of the application process (online, by email, post or in person), ESS collects personal data such as your name, address, date of birth and/or data that you have voluntarily provided to us. These data are used exclusively for the application process and are only accessible to a restricted group of people at ESS.

6.2 External recruitment agencies
In exceptional cases ESS works with external recruitment agencies. In this event you will be informed separately.

6.3 Establishment of an employment relationship
If an employment relationship is established, the data stored during the application process will be used for pre-contractual purposes (preparation of an employment contract).

6.4 Your data after the application process
Once the application procedure is complete, you will be informed about the status of your application. Personal data collected, processed and used by the applicant in connection with the application procedure will be deleted if the employment relationship is not established, at the latest 6 months after completion of the application procedure. Further storage of the data for future application processes will only take place after obtaining the applicant’s express prior consent.

6.5 Deletion of your applicant data
Should you wish to have your applicant data deleted, please send an email to info@ax3000-group.at.

7. OBLIGATIONS OF ESS

7.1 Data and processing results
ESS undertakes to process data and processing results only within the framework of a written order or contract.

If ESS is obliged by an authority to hand over your data, ESS is obliged to inform you immediately.

7.2. Confidentiality
All employees of ESS are obliged to maintain confidentiality in accordance with article 28 (3) of the GDPR and section 6 of the Austrian Data Protection Act as emended.

7.3 Notification and reporting obligations
In the event of a violation of data protection, ESS will inform you immediately, and at the latest within 24 hours of ESS becoming aware of the violation.

ESS will inform you immediately about any checks or measures taken by supervisory authorities where they relate to your data.

7.4 Security measures
ESS declares that sufficient technical and organisational security measures have been taken in accordance with article 32 of the GDPR and that they will be kept up to date.

7.4.1 Entry control
The offices are protected by an access control system and can only be entered by authorised employees.

7.4.2 Access control
All systems are secured by extensive password protection systems and are subject to authorisation to ensure that only authorised persons have access to data.

7.4.4 Input control
Personal data can only be recorded, changed and deleted by authorised persons.

7.4.5 Availability control
ESS confirms the ongoing performance of data backups and the monitoring of its operational requirements. Where necessary, emergency plans are available to keep possible outages of the operating system as low as possible.

8. YOUR RIGHTS

8.1. Right to be informed (art. 15 GDPR)
In accordance with article 15 of the GDPR, you have the right at any time to request information about all your data stored by ESS. In case of doubt, ESS may request additional information to confirm your identity. The email address set up at ESS for this purpose is: info@ax3000-group.at.

8.2. Right to rectification (art. 16 GDPR)
If ESS processes personal data that are incomplete or incorrect, you may request that they be rectified or completed.

8.3. Right to erasure (art. 17 GDPR)
You have the right to demand the erasure of your data at ESS if one of the following reasons applies:

a) The personal data are no longer necessary for the purposes for which they were collected or processed.

b) You withdraw your consent and there is no legal basis for further processing/storage.

c) You object to the processing and there are no legitimate reasons for further processing.

d) Your data have been processed unlawfully.

8.4. Right to restrict processing (art. 18 GDPR)
You may request ESS to restrict processing if

(a) you believe the data is not accurately processed, for the time necessary to enable ESS to verify the accuracy of the data

(b) the processing of the data is unlawful, but you do not want the data erased

c) the data are no longer needed by ESS for the purpose for which they were collected, but the data are still needed to exercise or defend legal claims.

(d) you object to the processing of the data.

8.5. Right to data portability (art. 20 GDPR)
You have the right to receive your personal data in a structured, standard and machine-readable format, provided that the data, based on your consent or for the performance of a contract, and processing is carried out by automated procedures.

8.6. Right to object to processing (art. 21 GDPR)
If your personal data are processed by ESS on the basis of Art 6 (1) item b or f, you have the right to object at any time, unless there is an overriding interest in the protection of the data.

You may object to the sending of advertising at any time without giving any reasons whatsoever.

8.7. Right to lodge a complaint
You have the right to complain to the designated supervisory authority if you believe that ESS violates Austrian or European data protection law.
